Shareholder Actions, Partnership Disputes & Securities Litigation
We represent individual shareholders, partners, members of limited liability companies, and investors in a variety of business litigation. Presently we are co-counsel on shareholder derivative actions representing shareholders of publicly-traded companies, including Beazer Homes USA, Inc. and CheckFree Corporation. In 2006, we won a six figure jury verdict for a minority shareholder who sued the majority shareholder for breaches of fiduciary duty and corporate mismanagement. We have represented numerous investors in cases alleging securities fraud, RICO, ERISA, and Broker misconduct. In 2006, we won a $13.3 million jury trial for an investor who lost $300,000 in an investment scam. We currently represent defrauded investors in a massive investment-fraud class action, which helped spark a federal investigation and civil lawsuit by the Federal Trade Commission.

Insurance-Related Disputes
We have represented publicly-traded companies, small businesses, and individual policy holders in suits involving insurance coverage disputes, declaratory judgment actions, and bad faith. In 2006, we achieved a favorable settlement during a jury trial alleging insurance broker malpractice. We are involved in insurance-related litigation throughout Metro Atlanta and North Georgia including disputes involving: general commercial liability, Director & Officer liability, automobile, homeowner, life insurance, and title insurance policies.

Personal Injury Cases
We represent individuals in a variety of personal injury and negligence cases. We represent people injured in automobile, motorcycle, and trucking accidents. We also represent plaintiffs in slip and fall, premises liability, and product liability cases. Unlike many plaintiffs' firms, we are not afraid to file suit and take a case to trial. And we have a proven track record of success. Most of our personal injury referrals come from other lawyers, which says a lot about our reputation and commitment to our clients.

Electronic Funds Transfer Act (EFTA) / Consumer Banking Disputes
The EFTA was enacted to protect the rights of consumers and establish the duties and responsibilities of financial institutions that electronically transfer funds. Our firm has represented various consumers in disputes with their banks and lending institutions. We have successfully litigated cases in federal court concerning violations of the EFTA and Uniform Commercial Code. We have also defended small business owners in collection cases and helped avoid personal liability on commercial loans and leases.

Legal Malpractice / Professional Negligence Cases
Maintaining the integrity of the legal profession is a responsibility of all lawyers. At the Law Office of David J. Hungeling, P.C., we have represented lawyers and their former clients in legal malpractice cases in federal and state court, and in disciplinary matters before the State Bar of Georgia. We have successfully defended lawyers and law firms and achieved positive results for individuals harmed by professional misconduct. In 2003, Mr. Hungeling helped achieve a multi-million dollar settlement for a publicly-traded company that sued its former lawyers for legal malpractice. We have also represented clients in other professional negligence matters, including engineering malpractice, insurance-broker malpractice, and medical malpractice.

Corporate Governance & Small Business Representation
We routinely provide legal counsel and advice to small business owners and their officers and directors regarding a variety of legal matters. We can provide practical advice regarding corporate governance because we are experienced litigating issues including breach of fiduciary duty, misappropriation of corporate opportunity, mismanagement, and corporate waste. We advise closely held businesses and partnerships through corporate divorces and internal disputes. We also assist our small business clients with contract review and negotiation, drafting employment and termination agreements, and drafting and enforcing non-compete agreements and shareholder agreements.
